The terms “we”, “us”, “our” and “Statusbrew” refer to Statusbrew LLC or our Services, as the case may be, and the terms “you” and “your” refer to a user accessing our services and/or visitor of our Services. If you are a corporate entity or an organization, references to the terms “you” and “your” shall include your employees, representatives and agents.

1. SCOPE OF THE POLICY
- This Privacy Policy applies to the information we collect through our Services
- To administer and manage your relationship with us, we will necessarily need to collect, use, disclose and/or process your Personal Data, to which you consent by agreeing to this Privacy Policy.
- The term “Personal Data” means any information that you provide to us which either directly or indirectly, whether true or not, about you or any other individual who can be identified from that data or in combination with other information we have or are likely to have access to.
- This Privacy Policy states the categories of Personal Data collected from you, the purpose, means, modes of collection of such Personal Data. It also sets out how we shall use, process, retain, disclose and destroy such Personal Data.
- It is necessary for us to collect and process your Personal Data for the purpose of providing Services. If you do not provide us with your Personal Data, or do not consent to this Privacy Policy or any amendments to this Privacy Policy, we may not be able to render the Services to you and you may be required to terminate your agreement with us and/or stop accessing the Site or using our services.

- We engage third parties who perform services on our behalf. We may upon your express and clear consent and in accordance with the Terms of Service and in compliance with the applicable laws, transfer certain Personal Data to these third parties. These third parties shall have access to your information and process it to the extent required to perform services/ tasks on our behalf and in a manner required by us. 2. PERSONAL INFORMATION WE MAY COLLECT
We request you to voluntarily provide us with certain Personal Data and you hereby consent to the collection of such Personal Data by us. The collection of your Personal Data shall be strictly restricted to what is necessary for the purpose of fulfilling the purposes identified herein below. We will not collect any Personal Data about you unless you voluntarily choose to provide it to us or as otherwise permitted by law. The information collected by us from you may include but is not limited to:
A. Personal Information Provided By You
- Registration. If you desire to have access to certain restricted Services of the Site or request to receive marketing materials, you may be required to become a registered user, and to submit Personal Information to Statusbrew which may include your name, email address, phone number, full username, password, city, and time zone. If you correspond with us by email, we may retain the content of your email messages, your email address and our responses. We also retain any messages you may send through the Services.
- Customer Support. We may collect information through your communications with our customer support team or other communications that you may send us and their contents.
- Making a Purchase. In case your payment information is requested for subscription of any of our Services, it will be collected and processed by our third party intermediary authorized payment vendor, Stripe, Inc. We do not directly collect or store payment information ourselves in the ordinary course of processing transactions. Payment information shared with our payment vendor shall be subject to their privacy and security policy available at https://stripe.com/privacy. We do not store your credit card or debit card number, card expiry date or other details pertaining to your credit/debit card on our Services.
- You may also voluntarily enter some Personal Data on our Site and/or mobile platform forms and customer interface channels, which we use to contact you.
- We ask for and may collect Personal Data from various sources, which may include but are not limited to, information you voluntarily provide us at any events, seminars, conferences, talks, promotions, surveys organized by us, and/or information we collect when you submit web forms on our websites or if you use interactive features of the websites. We record any personal information or other content that you provide to us at the time of providing feedback or registering a complaint.
B. Personal Information Collected from Connected Social Media Accounts
- If you connect your third party social media account to your Statusbrew account, Statusbrew may allow you to connect your third party social media account to your Statusbrew account, in which case we will access and collect certain information from your account(s) including but not limited to profile images, display names, username/page ID or profile ID, access tokens, sent posts. This includes the content of your post and engagement data (such as click rates, likes, re-shares, impressions, as well as general engagement counts), to the extent permitted by applicable law. This data will only be used by Statusbrew to provide you with the Service you expect and will not be shared with any third parties.
- Additionally, we may collect profile images, display names, username/page ID, access tokens, sent or received comments text and sent or received private message text from your Social Media accounts connected with Statusbrew. We may also collect profile images, display name, username/handle, access tokens, social account's insights data, demographic data, video insights, sent tweets, social account’s followers count, and social account’s audience data.
C. Personal Information Automatically Obtained from Your Interactions with the Service
- Log Data. When you use our Service, our servers automatically record information that your browser sends whenever you visit a website (“Log Data”). This Log Data may include information such as Internet Protocol (IP) address, web browser type, web browser version, internet service provider, the searches you undertake, language preferences, site trends, location, referring URL, timestamp information and the operating system that your computer or device is running. We treat such data in the same manner as we treat Personal Data voluntarily provided by you, under this Privacy Policy.
- Cookies and Similar Technologies. Like many websites, we also use “cookie” technology to collect additional website usage data and to improve the Site and our Service. A cookie is a small data file that we transfer to your computer’s hard disk. A session cookie enables certain features of the Site and our service and is deleted from your computer when you disconnect from or leave the Site. - Device Information: We collect information from and about the computers, phones, television, tablet and other web-connected devices that you use to access or integrate with our Services. The information we collect includes (i) device attributes that refers to information such as the operating system, hardware and software versions, signal strength, browser type, file names and types and plugins; (ii) device operations that refers to information about operations and behaviors performed on the device which can help us distinguish humans from bots; (iii) unique identifiers and device IDs; (iv) device signals; and (v) network connection information.
- Do Not Track: Statusbrew does not process or respond to web browsers’ “do not track” signals or other similar transmissions that indicate a request to disable online tracking of users who use our Service.
- Third-Party Web Beacons and Third Party Buttons: We may display third-party content on the Service, including third-party advertising. Third-party content may use cookies, web beacons, or other mechanisms for obtaining data in connection with your viewing of the third party content on the Service. Additionally, we may implement third party buttons, such as Facebook “share” buttons, that may function as web beacons even when you do not interact with the button. The fact that we link to a website is not an endorsement, authorization or representation of our affiliation with that third party. We do not exercise control over third party websites. D. Information collected from other sources
We may collect information which is provided, or made available by any third parties, law enforcement authorities, etc. We may collect such information to supplement the information that we collect directly from you for reasons including delivery of our services, performance of conditions of agreements and/or to comply with our legal and statutory obligations. We require each of these third parties to have the lawful basis to collect, use and share your data. Make sure to check their privacy and cookie policy so you know how they will use your information.
3. HOW WE MAY USE YOUR PERSONAL INFORMATION
We may use the Personal Information we obtain about you to:

4. HOW WE SHARE YOUR PERSONAL INFORMATION
We shall not sell, rent, share, disclose or transfer any of your Personal Data to any third party without your consent and without notifying you of the purpose for such transfer or sharing. We may disclose your Personal Data to the following third parties, for one or more of the above stated purposes:
- Social Media Platforms: Our primary purpose for using information is to publish your content on social platforms, allow you to track metrics for analytical purposes, and engage with customers through public replies and conversations (direct messages or “DMs”). We may allow you to link your account on Statusbrew with an account on a third party social network platform, and to transfer your information to and from the applicable third-party platform. Once you share your content to a social media platform, its use will be governed by that platform’s privacy policy.
- Service Providers: We engage certain trusted third parties to perform functions and provide services to us, including hosting and maintenance, error monitoring, analytics, debugging performance monitoring, billing, customer relationship, database storage and management, and direct marketing campaigns. We may share your Personal Information with these third parties, but only to the extent necessary to perform these functions and provide such services. We also require these third parties to maintain the privacy and security of the Personal Information they process on our behalf.
- Compliance with Laws and Law Enforcement: Statusbrew cooperates with government and law enforcement officials or private parties to enforce and comply with the law. To the extent permitted under the applicable law, we may disclose any information about you to government or law enforcement officials or private parties as we reasonably believe is necessary or appropriate to investigate, respond to, and defend against claims, for the legal process (including subpoenas), to protect the property and rights of Statusbrew or a third party, to protect Statusbrew against liability, for the safety of the public or any person, to prevent or stop any illegal, unethical, fraudulent, abusive, or legally actionable activity, to protect the security or integrity of the Service and any equipment used to make the Service available, or to comply with the law.

- We may upon your express written consent make certain non-Personal Information available to third parties for various purposes, including for business or marketing purposes or to assist third parties in understanding our users’ interests, habits, and usage patterns for certain programs, content, services, advertisements, promotions, and functionality available through the Service.
- We may with your prior and expressed consent share Personal Data for reasons not described in this Privacy Policy with third parties.
- We may store information in locations outside the direct control of Statusbrew (for instance, on servers or databases co-located with hosting providers and on cloud service providers). Whenever in the course of sharing personal information to other countries, we ensure that the information is transferred in accordance with applicable laws on data protection.
- Except as otherwise described in this Privacy Policy, Statusbrew will not disclose personal information to any third party unless required to do so by law or subpoena or if we believe that such action is necessary to (a) conform to the law, comply with legal process served on us or our affiliates, or investigate, prevent, or take action regarding suspected or actual illegal activities; (b) to enforce our Terms of Service, take precautions against liability, to investigate and defend ourselves against any third-party claims or allegations, to assist government enforcement agencies, or to protect the security or integrity of our site; and (c) to exercise or protect the rights, property, or personal safety of Statusbrew, our Users or others.
- We may share non-personally identifiable information (such as anonymous usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with third parties to help us track and understand usage patterns.

5. HOW WE PROTECT YOUR PERSONAL INFORMATION
- Statusbrew is extremely concerned about safeguarding the confidentiality of your Personal Information. 6. RETENTION
We will retain your Personal Data for as long as required to perform the purposes specified under this Privacy Policy. Upon termination of your account by cancellation or suspension, your Personal Data is destroyed or anonymised from our records and system in accordance with our retention policy in the event your Personal Data is no longer required for the said purposes unless its further retention is required to satisfy a longer retention period to meet our operational, business, legal or other statutory requirement.

Our Services may contain links to other third party websites. Please remember that when you use a link to go from our website to another website, our Privacy Policy is no longer in effect. 8. CAN-SPAM COMPLIANCE NOTICE (U.S. and Canadian users only)

Please note that it may take up to 10 business days for us to process opt-out requests. 9. DATA TRANSFERS
- Statusbrew is based in the United States. Personal Information that we collect may be transferred to, and stored at, any of our affiliates, partners or service providers which may be inside or outside the European Economic Area (“EEA”), the United Kingdom and Switzerland, including the United States. By submitting your personal data, you agree to such transfers. Your Personal Information may be transferred to countries that do not have the same data protection laws as the country in which you initially provided the information. When we transfer or disclose your Personal Information to other countries, we will protect that information as described in this Privacy Policy.
- If you are located in the European Economic Area ("EEA") or Switzerland we will comply with applicable legal requirements for the transfer of Personal Information to countries outside of the EEA, United Kingdom or Switzerland. In particular, Statusbrew has filed its certification of adherence to the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework as set forth by the Department of Commerce and the European Commission, and the Swiss Federal Data Protection and Information Commissioner, respectively, with respect to the processing of certain Personal Information transferred from the EEA and Switzerland to Statusbrew. In addition, we may enter into Standard Contractual Clauses issued by the European Commission with our commercial customers where appropriate.
10. USER RIGHTS
Additional Terms and Conditions for Certain Regions
(i) European Union (EU)
This section is applicable only to persons in the European Union. We ensure that all your data that we collect, store, use and process is done in compliance with the General Data Protection Regulation (GDPR).
a) The term Personal Data means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that person.
b) Legal basis for processing your Personal Information: If you are an EU citizen, we process personal information only for purposes for which we collect it. We shall process data only if we have your consent or if processing is necessary for complying with our legal obligations or where the processing is in our legitimate interest. c) Your Rights under GDPR
Residents of the European Union have certain additional rights in relation to their Personal Data under the General Data Protection Regulation (GDPR)
- Right to access: You have a right to and are allowed access to your Personal information that is processed.
- Right to erasure: You may request erasure of your Personal data only under certain circumstances which include but are not limited to unlawful processing of your data, if your Personal Data is no longer necessary in relation to the purposes for which it was collected or otherwise processed, if you withdraw your consent etc. Please note, however, that we may need to retain certain information to comply with our legal obligations.
- Right to rectification: You may at any time request for rectification of your Personal Data that we process. You may also complete Personal data if it is incomplete.
- Right to restriction of processing: You have a right to restrict the processing of Personal Data if you contest the accuracy of the data, lawfulness of processing and or if you have objected to processing of data or if the data is no longer needed for the purpose of processing. We will inform you when such restrictions are lifted.
- Right to data portability: You have a right to receive the Personal Data you have provided to us in a structured, commonly used and machine-readable format. You are also entitled to the right to transmit your Personal data to another controller to another where it is technically feasible.
- Right to object: You have a right to object to the processing of your Personal Data. You have a right to object where your Personal Data is processed for marketing purposes.

d) Transfer of Personal Data: Kindly note that you are signifying agreement to the transfer of your Personal Information to outside the EU. Such transfer to which you hereby expressly consent is primarily for processing and we ensure an adequate level of protection through a series of agreements with our Service providers.
(ii) California Consumer Privacy Act (CCPA)
a) If you are a resident of California, we shall handle your Personal Data in consonance with the California Consumer Privacy Act (CCPA). We will not, without your consent, disclose your Personal Data.
b) We will not, without your consent, sell and/or disclose your Personal Data for valuable consideration. If you have given us your Personal Data, we have not sold and/or disclosed it for valuable consideration in the 12 months immediately preceding the last update of this Privacy Policy.
c) You consent and agree that we may disclose the following categories of such Personal Data of consumers (as defined under the CCPA) in the 12 months immediately preceding the last update of this Privacy Policy.

(iii) UK Data Protection Act, 2018

(iv) Swiss Federal Act on Data Protection (FADP), 2023
If you are within the territory of Switzerland we shall handle your Personal Data in consonance with the Federal Act on Data Protection, 2023. As a Data Subject. As a Data Subject, the following are your rights under the Federal Act on Data Protection, 2023:
a) Right to be informed: Statusbrew is required to inform you of the collection and processing of personal data. At a minimum, we need to inform you about: (i) the identity and the contact details of Statusbrew; (ii) (where applicable) the contact details of the data protection officer ('DPO'); (iii) the contact details of the Swiss representative, if any; (iv) the purposes of the processing of personal data; (v) the recipients or categories of recipients of the personal data, if any; (vi) the categories of personal data concerned, where the personal data is not obtained directly from the data subject; (vii) where Statusbrew intends to transfer personal data to a recipient outside of Switzerland, the countries the we intend to transfer personal data to, and (in the absence of an adequacy decision taken by the Federal Council) based on which safeguards (e.g. Standard Contractual Clauses ('SCCs') or derogations; and (viii) (where applicable) the existence of automated individual decision-making.
b) Right to access: FADP provides you with the right to access personal data undergoing processing and which relate to you. FADP sets out a list of minimum elements of information that a controller needs to provide in response to access requests, namely: (i)the identity and contact details of the controller; (ii) the personal data undergoing processing (this includes a right to receive a copy of the personal data); (iii) the purposes of the processing; (iv) the storage duration or, if not possible, the criteria used to determine this duration; (v) (if the controller has not obtained the personal data directly from the data subject) the available information as to the origin of the personal data; (vi) (if any) the existence of automated individual decision-making and information about the logic involved; and (vii) (if any) the recipients or categories of recipients of the personal data. Requests, made in writing, can be electronic or on paper. The controller verifies the data subject's identity, providing information within 30 days or informing if more time is needed. Refusal is allowed under legal obligations, third-party interests, or manifestly unfounded requests.
c) Right to rectification: You have a right to ask for rectification of an inaccurate data that Statusbrew holds. However, Statusbrew may refuse to rectify incorrect personal data if a statutory obligation prohibits the rectification or if the personal data is being processed for archiving purposes in the public interest.
d) Right to erasure: You have the right to object to the processing of personal data provided and this right includes the right to erasure. However, Statusbrew may refuse to delete personal data based on legal obligations or prevailing private or public interests.
e) Right to object/opt-out: FADP provides you a right to object to the processing of their personal data (essentially an opt-out right). The objection/opt-out right is, however, not absolute. These rights are subject to the following conditions: (i) the controller processes the data in an automated manner; and (ii) the data is processed with the data subject's consent or in direct connection with the conclusion or performance of a contract with the data subject.
g) Right not to be subject to automated decision-making: Statusbrew is obligated to inform data subjects if they use automated individual decision-making. In addition, Statusbrew has to grant data subjects have a right to be heard in the case of automated individual decision-making.These obligations will not apply if the decision is made in connection with the conclusion or the performance of a contract with you, and where the Statusbrew grants the request made by you or if you have consented to the automated individual decision-making.
(v) Rights under Digital Personal Data Protection Regulation, 2023 (DPDPA)
If you are within the territory of India or if your data is digitally collected within India, the following are the rights available to you as a Data Principal under the Digital Personal Data Protection Act, 2023:
a) Right to access information about personal data- You have the right to request a summary of your personal data processed by Statusbrew; identities of all other entities with whom your personal data is shared along with the description of personal data shared and any other information regarding your personal data and its processing.
b) Right to correction and erasure- You shall the right to request correction, completion, updating and erasure of your personal data
c) Right to restrict processing of personal data- You have the right to restrict the processing of your personal data in certain circumstances. For example, you can restrict the processing by unsubscribing from our list.

11. CHILDREN’S PRIVACY
